PURPOSE OF THE JOB

·        To ensure that arrear and non-performing accounts are managed effectively to minimise Companys losses.

 

KEY RESPONSIBILITIES

·        Manage all Legal Accounts in conjunction with the relevant parties, in a manner which ensures maximum recovery in the shortest possible time frame;

·        Manage and monitor all legal accounts handled by Company and our attorney(s). Decide on action to be instituted, strategy to follow, whether to abandon, terminate, to sue for damages, specific performance etc;

·        Assist with all defended matters - prepare for trial and represent Company in court as witness in defended matters;

·        Attach/repossess, store, and liquidate/sell financed assets;

·        Attend to settlement negotiations on legal matters;

·        Attend meetings with clients and / or attorneys;

·        Monitor insolvencies-liquidations, sequestrations, business rescue, curatorship etc. Submit claims, sign affidavits, monitor dividend payments, check liquidation and distribution account for possible undue preference or dispositions, call for advanced dividends etc.;

·        Manage own non-performing book effectively;

·        Draft, where necessary, supplementary and supporting agreements;

·        Manage and contain all internal & external costs associated with the collection of outstanding agreements;

·        Assist with impairments and other reports required relative to the Legal Book and present at relevant managerial meetings;

·        Recommend write offs after all avenues of recovery have been exhausted;

·        Provide ad hoc legal advice to the business specifically with regards to Asset Finance, document drafting, and due process;

Requirements

EDUCATIONAL REQUIREMENTS

·        Grade 12 (Matric);

·        LLB, BCom Law, or relevant Legal degree;

·        Minimum 4 years Banking Credit Control experience

 

KNOWLEDGE REQUIREMENT

·        Understanding and exposure to Mag/High Court litigation;

·        Able to train and guide supporting staff;

·        Good Time Management skills;

·        Proficient in law of contract, law of cession, evidence, insolvency and civil procedure;

·        Knowledge of consumer protection obligations;

·        Sense of urgency, proactive;

·        Excellent written and verbal English communication skills;

·        High confidence level;

·        Excellent understanding of Debtors Collections and Product Knowledge (specifically Asset Based Finance, Instalment

·        sale, Operating Rental & Financial Lease Agreements);

·        Knowledge of the legal process / insolvencies and all Acts surrounding the collection of debts;

·        Excellent interpersonal skills;

·        Attention to detail;

·        Proficiency in MS Office / Excel;

·        Must be able to work in a team but still be independent;

·        Risk control/Credit control;

·        Thorough knowledge and understanding of applicable legislation (NCA,CPA);

·        Knowledge and understanding of Credit and Risk Policies & Procedures;
